Adam Air hits severe financial problems; may be shut down in three weeks

Monday, March 17, 2008

Indonesian budget airline Adam Air has been given a three-week ultimatum by the authorities to prove its economic stability or its license will be revoked, said Transportation Minister Jusman Djamal. This is because major financial difficulties have become apparent today, with two major shareholders pulling out of the company.

PT Global Transport Service (GTS) and Bright Star Perkasa, who between them own a 50% stake in the company, have decided to sell back all their shares to their original owners, who control the other 50%. These are the family of founder Adam Suherman and Sandra Ang.

The companies invested in the airline last year, when the company was struggling after the New Year’s Day disappearance of Adam Air Flight 574 with 102 on board. The Boeing 737 (B737) was ultimately determined to have crashed into the sea near Sulawesi, and all on board are presumed dead. Shortly afterwards, Adam Air Flight 172, another B737, snapped in half during a hard landing, but held together preventing fatalities. These were not the first serious accidents for the company, as in February 2006 Flight 782 became lost for several hours after navigation systems failed and the plane entered a radar blackspot, forcing a subsequent emergency landing many miles from the intended route. The given reasons for the withdrawal are a lack of improvement in safety and financial irregularities.

The company has now also defaulted on debt payments to aircraft lease firms, resulting in 12 of their 22 planes being seized, and has cut the number of routes served from 52 to 12. The remaining ten planes are also in default and at risk of seizure. Adam Air owes leasing companies US$14 million compared to free capital of $4.8 million of free capital. They have agreed to buy back shares gradually for $11 million (100 billion rupiah), $6 million less than the investment firms paid for them. The cost difference will be borne by Harry Tanoesoedibyo’s family, the founder of PT Bhakti Investama, of which GTS is a wholly owned subsidiary. The companies have also lost 157 billion rupiah worth of investment in the company since the April 2007 deal. 9,325 Rupiah are currently worth US$1.

GTS director Gustiono Kustianto said that “Since we joined, our priority has been safety” but that Adam Air’s management had been unresponsive to pressure from the new investors to improve its poor record. Last weeek another company B737 shot off the runway during landing, damaging the plane and injuring five.

Lawyer Marx Andryan of Hotman Paris Hutapea, representing the investment firms, said they have documents proving the company has not adequatly seen to pilot recruitment, maintenance and insurance.

Suherman said “We have defaulted and the investors have done nothing about it. We’ll continue to operate as long as we have planes,” adding that there are no current plans to declare bankruptcy.

“Out of 22 planes, now we only have 10 because 12 of them have been declared in default. The other 10 have been declared in default as well, but I’m still trying to work out a way to restructure the payments,” he told Reuters. He went on to say that a cash injection is required, and that “There is a possibility starting on March 21 Adam Air will temporarily cease operations until there is a decision from the shareholders regarding the insurance premium.”

Dental CT Scanning and Benefits for Implant Cases

by

Ct-dent.co.uk

The use of imaging technology is essential in a dental implant treatment. The images obtained through CT scanning will be used in determining the suitability of a patient for a dental implant procedure. Dental CT scans are also very beneficial in the formulation of an appropriate treatment plan, so that the entire procedure can be carried out successfully, with increased safety – and with high precision end results that both the dentists and the patients are aiming for.

A 3D CT (computerised tomography) scan of the teeth and the whole oral cavity provides a three-dimensional image that enables dentists/dental implantologists to see the density of the jaw bone, which in turn will help in the accurate planning of where the implants will go (and even what type of implant will be used). X-rays, which were used during earlier years, provided only two-dimensional images that come with numerous limitations when it came to the precision of diagnostics that are essential in dental implant treatments.

Benefits of CT Scanning for Implant Treatment

CT scanning provides accurate imaging information that helps in the formulation of a dental implant treatment plan, compared to X-rays that showed limited information when it comes to the quality of the images obtained. The quality of a patient s jaw bone can be seen clearly with the three-dimensional images, and can help in determining the eligibility for an implant procedure. The need for additional procedures, such as bone grafting or sinus grafts, can also be determined with the help of the clear images.

The clear images provided by CT scanning can make the entire implant treatment much safer for the patient, minimising the risks associated with complicated dental procedures. A higher success rate can also be expected with the help of images obtained through CT scanning, since the exact location of the implant is known before the procedure itself; the type of dental implant to be used is also determined beforehand with the help of the highly-accurate images.

The clear, precise images obtained with a CT scan allow a dental implant to be placed in a single dental visit (for patients who are eligible for same day dental implants). The exact location where an implant needs to be placed can easily be determined with the help of the three-dimensional images, enabling a dentist to make a highly-accurate placement in a shorter period of time.

CT scans are also very helpful in cases when bone grafts are needed before the actual implant treatment. As the three-dimensional images show the quality and thickness of the jaw bone, it will be easier to determine the volume or amount of bone needed for the bone grafting procedure.

Video of man tasered at Vancouver airport released

Thursday, November 15, 2007

A video showing a man being tasered by police and subsequently dying at the Vancouver International Airport has been released to the media. The cause of his death has not yet been determined.

Robert Dziekanski, 40, was immigrating from Pieszyce, Poland to live with his mother, Zofia Cisowski, in Kamloops, British Columbia. He did not clear customs at the airport for over eight hours and his mother was unable to locate him when she went to meet him at the airport. Since Dziekanski did not speak English airport security guards were unable to properly communicate with him. He started yelling at the airport staff because of this. He used chairs to prop open a door between a customs clearing area and a public lounge, he then threw a computer and threw a small table at a luggage section window.

He had calmed down and was standing with his hands at his side in the customs room until four Royal Canadian Mounted Police (RCMP) officers arrived and tasered the man, at least twice. Dziekanski began to convulse and was tasered a second time after falling to the ground, where the four officers pinned him down and handcuffed him. He screamed before he stopped moving. Paramedics arrived at the scene, but were unable to revive him and pronounced him dead.

Dziekanski’s mother had told him to wait in the luggage area where she would meet him, not realizing that this was inside the airport’s security zone, which was inaccessible to her. Arriving international passengers need to pass through customs first, before being able to meet people waiting to pick them up. His mother had tried in vain to get a message to him and eventually left the airport when told by airport staff that he wasn’t there.

Paul Pritchard, who had just arrived from China back to Victoria, shot a video of the incident and gave it to police. The police promised they would return the video within 48 hours. They gave him back his camera without the video.

Pritchard immediately hired a lawyer, held his own news conference, and threatened that he would take them to court to get it back.

CBC, CTV and Global television paid Pritchard several thousand dollars for the video, and he says he will use the money to take care of his father.

“It was against his [Pritchard’s father] wishes completely and my lawyer’s wishes as well. Profit is such an ugly word, and I hope people realize that it’s not a personal profit,” said Pritchard.

“I extend my heartfelt condolences to Mr. Dziekanski’s family, knowing that I could not hope to speak to the loss that they have suffered. I would also like to express my concerns for those people who were in any way touched by this extraordinary and tragic occurrence – our employees working that night, the various agencies involved, the emergency responders and the passengers who may have come across the scene,” Larry Berg, President and CEO of the Vancouver Airport Authority said on November 1.

According to a RCMP spokesman in Vancouver, the four officers involved in the case will testify in court under the coroners request, but it is expected to happen sometime next year.

Polish ambassador to Canada, Piotr Ogrodzinski, said “Mr. Dziekanski (was) a person who was agitated, frustrated, I think terrified, but not aggressive. He was not making a gesture that he intended to fight anybody” and “he didn’t know what to do. In fact, he was in search (of) help. That is why it is a really very sad and deeply moving film to watch.”

The incident is being investigated by the RCMP, the British Columbia Coroner’s Service, the Vancouver International Airport Authority, and the Commission for Public Complaints Against the RCMP.

Insurance Adjusters Negotiation Techniques In Personal Injury Cases

by

Personal Injury Lawyer Albuquerque Directory

If you ve been in an accident, have been injured and are considering pursuing a personal injury claim, you should never attempt to deal with an insurance company on your own.

Your first contact with an insurance company will be through an insurance adjuster. They work for the insurance company and their job is to settle a case as quickly and inexpensively as possible and they re very good at that. It’s your job to make sure you get a fair shake.

To do this, you are best advised to hire an experienced personal injury attorney. They deal with insurance companies every day. They know all the tricks insurance companies employ in an attempt to get you to settle quickly for less money, and they employ a lot of tricks. You will be at an extreme disadvantage if you try to deal with them yourself.

Here are some things you should be aware of:

The musical chairs game. You start out with one adjuster then the claim gets reassigned to another adjuster with no explanation to you. This makes you renegotiate already-settled points if they are not in writing.

Dealing with different adjusters helps the insurance company isolate different issues. One adjuster will settle the total loss, another will settle fault, and a third one will settle the injury. This way, insurance adjusters can keep you off guard and not give you a straight answer.

You can t prevent this from happening but the best way to deal with it is to establish a paper trail. Put everything they agree to or tell you in writing and send them a cover letter to that effect. This way, when the claim is reassigned, you can point to your correspondence and show what the insurance company has already agreed to.

Changing the shape of the money. The adjuster will offer a sum of money that would be ideal for a Nice trip to Mexico for two or A big flat screen TV.

This is very powerful. They get you to thinking about trips or electronics instead of your pain and suffering. This “helps” the injured party “spend the money in their heads,” and makes them want to settle most often for less. Think in terms of real dollars, there is simply too much at stake.

Do things at your convenience. Adjusters want to call you when it is inconvenient for you. They ll call when you are about to go to work or sit down to dinner. The goal is to put pressure on you to settle right there.

Why not turn the tables on them? Call the adjuster right before lunch time or before a three day weekend. Tell them right before the weekend to picture themselves relaxing with one less claim to worry about when they come back to the office.

What time of year is it? Most people are looking for money before or after a holiday, so insurance companies push adjusters to be more aggressive around the holidays.

Adjusters are savvy and this is a great time for them. Think about it. You need money for the kids’ Christmas toys. Once again they want you to spend the money in your head. If they can do that, you ll settle for less.

Silence is the name of the game. Adjusters are trained to make an offer then stop talking. This often works because silence makes people uncomfortable. If they can get you to talking about the number they ve offered, they re ahead of the game. Don t do this. Turn things around by making a counter-offer and hit the mute button!

Avoid psychologically loaded questions. When you do make a statement, watch out for loaded questions. An adjuster might ask things like: How could you have avoided the auto crash? or How much do you think you are responsible? or Did you have any previous injuries like back or neck pain before the accident? These are questions designed to get you to say more than you should things that can be used against you later on.

Be ready to push back. While you’re waiting to hear from the adjuster do your own homework. Find out everything you can about your particular kind of accident. If your car was damaged, get comps of comparable makes and models. If your car is declared a total loss, you want to know a realistic replacement cost so you can judge whether the adjuster’s offer is fair.

Remember: Insurance companies are in business to make money. They do that by taking in more than they pay out. It’s in their best interest to get you to accept a bare minimum, so always be prepared to push back.

As you can see, dealing with insurance companies can be brutal. The best way to counter this is to hire an experienced personal injury attorney. You ll get a far better settlement by doing so.

Former Taiwanese President Chen Shui-bian released on bail

Saturday, December 13, 2008

Taiwan’s former President, Chen Shui-bian (???), has been conditionally released on bail, some ten hours after he was indicted for corruption. Speaking to media at the Taipei District Court, he said: “I want to thank my lawyers, members of the Democratic Progressive Party and my supporters who have given me huge encouragement. I am grateful to those who cared for, supported and looked after me so I could get through the hardest and loneliest 32 days of my life in prison.” He earns the historical distinction of being the first ex-president of the Republic of China to be indicted for criminal offenses and could suffer life imprisonment if convicted.

Along with 13 other family members and close associates, including his wheelchair-bound wife, son Chen Chih-Chung, and daughter-in-law Huang Jui-ching, Chen was indicted Friday on charges of embezzling government funds and laundering money or ill-gotten bribes. The panel of three judges ruled he should appear at future court hearings and must not leave the country nor change his address.

Prosecutor Lin Che-hui accused Chen of having “embezzled 104 million New Taiwan dollars ($3.12 million) from a special presidential fund, and received bribes of $11.73 million in connection with a government land procurement deal and a separate construction project; the damning piece of evidence was the presence of NT$740 million ($22.2 million) in cash stashed in a Taipei bank safety vault held by the Chens.” Yuanta Securities director Tu Li-ping said, “she hand delivered NT$200 million ($6 million) in cash to Wu at the presidential residence in 2006 on behalf of executives of an affiliated bank; the money was an incentive for Wu not to interfere with a merger the bank was pursuing.”

Chen insists on his innocence. Contradicting the 100-page indictment, he said that “the $21 million his wife wired to their son’s Swiss bank accounts came from leftover campaign donations. Taiwanese law permits such donations to be kept by political candidates.”

In 1975, Chen married Wu Shu-chen (???), the daughter of a physician. The couple has a daughter, Chen Hsing-yu (???), who is a dentist; and a son, Chen Chih-Chung (???), who, having received a law degree in Taiwan, studied at and graduated with a M.A. degree from the University of California in 2005.

In November 2006, Chen’s wife Wu Shu-chen and three other high ranking officials of the Presidential Office were indicted for corruption, charged with misappropriating NT$14.8 million (USD$450,000) of government funds using falsified documents. Due to the protection from the Constitution against prosecution of the sitting president, Chen could not be prosecuted until he left office, and he was not indicted, but was alleged to be an accomplice on his wife’s indictment.

Chen’s term as President of the Republic of China ended in May 2008. Immediately thereafter, prosecutors began investigating him regarding allegations that he misused his discretionary “state affairs fund”, as well as his connection to the first family’s money-laundering activities. He resigned from the Democratic Progressive Party on August 15, 2008, one day after admitting to falsifying past campaign expenses and wiring campaign contributions to overseas accounts.

In November 2008, Chen was escorted by a security staff, into the Taipei prosecutor’s office for questioning. After 6 hours, he left the Supreme Court prosecutor`s office in handcuffs, was arrested and detained. The charges each carry a minimum penalty of 5 years imprisonment. Following a 6 day hunger strike while in detention, Chen collapsed and was rushed to Taipei’s Far Eastern Memorial Hospital, where he was later transferred to Panchiao Hospital for force-feeding. Despite Chen’s lack of interest in appealing, his lawyer Cheng Wen-long completed a motion seeking his release from detention and filed a notice of appeal of the court’s decision, along with a petition for constitutional interpretation to restrain actions violative of the Constitution.

Prosecutor General, Chen Tsung-ming said that after Chen’s case had been removed to the Taipei Local Court, he would re-file a petition for Chen’s detention. Chen and the main opposition DPP have accused President Ma Ying-jeou‘s administration of “using the scandals to plan a political plot against the former leader.”

Meanwhile, The Straits Times reported that “prosecutors are to investigate former President of the Republic of China and Chairman of the Kuomintang from 1988 to 2000, Lee Teng-hui on suspicion of money laundering, based on allegations made by Chen during his own questioning recently that his predecessor transferred large funds abroad through dummy accounts.” Mr. Lee angrily denied the accusations concerning “a suspected transfer of 50 million Taiwan dollars (US$2.26 million) to Mr Lee from a local stock investor via overseas dummy accounts.” Charges also included transactions made at the end of Lee’s tenure and at the beginning of Chen’s term, including “one billion Taiwan dollars that had been wired to various countries including Singapore.”

The China Post calls for calm and urges fair trial for Chen. “All the people should wait patiently for the outcome of the trial … They shouldn’t do anything to influence the judges in any way, because the rule of law in Taiwan is at stake. We should show the world that Taiwan is a democracy where anybody who commits a crime, be he a man on the street or a former president, is duly punished.” it said.

Tropical moisture ceases to cause severe floods in South East Australia

Friday, March 26, 2021

On Tuesday, higher than average amounts of precipitation have ceased in New South Wales (NSW), south of Queensland, and north-east of South Australia. Over the course of the prior five days, these heavy rains caused floods and hazards to farms and dwellings, with up to a month quantity of rainfall falling within 48 hours on Monday and Tuesday in some areas, notably 150mm of rain at the Great Dividing Range, Bureau of Meteorology (BoM) reported.

On Tuesday, BoM said the situation reportedly started to ease, with rains moving towards the east, but emphasised the water levels were continuing to rise in some areas and many flood alerts remained active. Meteorologists said the eastern areas may clear from floodwater quickly, the other regions to the west of the Great Dividing Range would be affected for much longer, potentially weeks or months before the water levels come back to normal. Thick fog was likely to occur at approximately this coming weekend as air temperatures drop below dew point at night and mist may develop, meteorologists warned, as News.com.au reported.

In Taree, NSW, ABC News reported multiple cows rescues in rivers and in the surf, and an instance of a dwelling being reportedly swept from premises on a wedding day of its owners. ABC News reported a farmer losing his animals and his house at Mid-North Coast. Of residential areas, Hawkesbury continued to experience raising levels of flood as of Monday. Ian Wright, a researcher from Western Sydney University, commented saying the floods in Hawkesbury are dangerous due to the terrain and rigorous water supply from adjacent rivers to the area, citing a related publication about it by the State Emergency Service.

On Monday, NSW Police has rescued a 80-year old woman trapped in a car at River Road, Wyong, Central Coast, with the car subsequently falling into the river shortly after the rescue was completed.

Local authorities warned people to stay away from flooded areas. Bureau of Meteorology issued Road Weather Alert for Sydney for all suburbs on Monday. Government agencies, including Disaster recovery officer Simon Oliver, from the Department of Primary Industries, said the government would offer support to people affected by the flood. Oliver said, “While it’s still early days, we are planning to provide support including emergency fodder as well as support for those who need to move or dispose of stock [animals].”

BoM reported the weather may clear on Wednesday as a warmer, drier mass of air was expected to increase, with a coastal low entering Bass Strait on Wednesday.

Since March 16, Australian BoM has issued severe weather, marine wind, hazardous surf, and numerous minor to major flood warnings for the affected areas. La Niña was nearing its end, with the effects persisting in late March and early April, Bureau of Meteorology reported last week.

World’s first double arm transplant undertaken in Munich

Saturday, August 2, 2008

A 54-year-old German farmer who lost both arms in a farming accident six years ago has become the first patient to receive a complete double arm transplant. The patient, whose name has not been released, underwent the operation at the Klinikum rechts der Isar, part of the Technical University of Munich (Technische Universität München), last week; he is said to be recovering well.

The operation lasted 15 hours and was performed by a team of 40 specialists in Plastic Surgery, Hand Surgery, Orthopedics and Anesthesiology, under the direction of the head of the Plastics and Hand Surgery department, Prof. Hans-Günther Machens, Dr. Christoph Höhnke (Head of Transplants, Senior Physician; Plastics and Hand Surgery) and Prof. Edgar Biemer, the former Chief of Plastic Surgery at the Clinic.

In a press statement released by the clinic, it was revealed that the patient had been thoroughly physically checked and had psychological counselling prior to the surgery to ensure he was mentally stable enough to cope with the procedure. Since completion of the surgery, the patient has been on immuno-suppressant drugs to prevent rejection of the new limbs.

Following the surgery, the press release from the clinic’s press manager, Dr. Tanja Schmidhofer, included the following statement:

The flow of blood was [re-]started in intervals of 20 minutes because the anaesthetists had to make sure that the patient would not suffer from the blood flowing back from the transplanted parts. No significant swelling was seen, nor indeed any ischemia (lack of blood flow to the tissues). This is a testament to the surgeons who established a fully functioning blood flow…the main nerves, the Musculocutaneus, Radial and Ulnar nerves were all attached and sewn together, and finally an external fixator was applied, with pins in the lower and upper arms, avoiding the risk of pressure points and sores. The operation was successfully completed after 15 hours.

Without the immuno-suppressant drugs given to the patient, the risk of there being a Graft-versus-Host Reaction or GvHR, would have been significant due to the upper arm containing a large amount of bone marrow, consisting of ICC’s or Immuno-Competent Cells, which would have triggered a near total rejection of the new limbs. A GvHR is a condition which results in the cells from the transplant attacking the immune system of the body.

Indications from the clinic suggest that the double attachment went well, although it could be up to 2 full years before the patient is able to move the arms.

The donor arms came from an unnamed teenager, who is believed to have died in a car accident.
