Chula Vista, California becomes model for blight control laws in the US

The San Diego, California suburb of Chula Vista has responded to the recent housing crisis with an aggressive blight control ordinance that compels lenders to maintain the appearance of vacant homes. As foreclosures increase both locally and throughout the United States, the one year old ordinance has become a model for other cities overwhelmed by the problem of abandoned homes that decay into neighborhood eyesores.

Chula Vista city code enforcement manager Doug Leeper told the San Diego Union Tribune that over 300 jurisdictions have contacted his office during the past year with inquiries about the city’s tough local ordinance. Coral Springs, Florida, and California towns Stockton, Santee, Riverside County, and Murietta have all modeled recently enacted anti-blight measures after Chula Vista’s. On Wednesday, 8 October, the Escondido City Council also voted to tighten local measures making lenders more accountable for maintenance of empty homes.

Lenders will respond when it costs them less to maintain the property than to ignore local agency requirements.

Under the Chula Vista ordinance lenders become legally responsible for upkeep as soon as a notice of mortgage default gets filed on a vacant dwelling, before actual ownership of the dwelling returns to the lender. Leeper regards that as “the cutting-edge part of our ordinance”. Chula Vista also requires prompt registration of vacant homes and applies stiff fines as high as US$1000 per day for failure to maintain a property. Since foreclosed properties are subject to frequent resale between mortgage brokers, city officials enforce the fines by sending notices to every name on title documents and placing a lien on the property, which prevents further resale until outstanding fines have been paid. In the year since the ordinance went into effect the city has applied $850,000 in fines and penalties, of which it has collected $200,000 to date. The city has collected an additional $77,000 in registration fees on vacant homes.

Jolie Houston, an attorney in San Jose, believes “Lenders will respond when it costs them less to maintain the property than to ignore local agency requirements.” Traditionally, local governments have resorted to addressing blight problems on abandoned properties with public funds, mowing overgrown lawns and performing other vital functions, then seeking repayment afterward. Chula Vista has moved that responsibility to an upfront obligation upon lenders.

That kind of measure will add additional costs to banks that have been hit really hard already and ultimately the cost will be transferred down to consumers and investors.

As one of the fastest growing cities in the United States during recent years, Chula Vista saw 22.6% growth between 2000 and 2006, which brought the city’s population from 173,556 in the 2000 census to an estimated 212,756, according to the U.S. Census Bureau. Chula Vista placed among the nation’s 20 fastest growing cities in 2004. A large proportion of local homes were purchased during the recent housing boom using creative financing options that purchasers did not understand were beyond their means. Average home prices in San Diego County declined by 25% in the last year, which is the steepest drop on record. Many homeowners in the region currently owe more than their homes are worth and confront rising balloon payment mortgages that they had expected to afford by refinancing new equity that either vanished or never materialized. In August 2008, Chula Vista’s eastern 91913 zip code had the highest home mortgage default rate in the county with 154 filings and 94 foreclosures, an increase of 154% over one year previously. Regionally, the county saw 1,979 foreclosures in August.

Professionals from the real estate and mortgage industries object to Chula Vista’s response to the crisis for the additional burdens it places on their struggling finances. Said San Diego real estate agent Marc Carpenter, “that kind of measure will add additional costs to banks that have been hit really hard already and ultimately the cost will be transferred down to consumers and investors.” Yet city councils in many communities have been under pressure to do something about increasing numbers of vacant properties. Concentrations of abandoned and neglected homes can attract vandals who hasten the decline of struggling neighborhoods. Jolie Houston explained that city officials “can’t fix the lending problem, but they can try to prevent neighborhoods from becoming blighted.”

CEO Robert Klein of Safeguard, a property management firm, told the Union Tribune that his industry is having difficulty adapting to the rapidly changing local ordinances. “Every day we discover a new ordinance coming out of somewhere”, he complained. Dustin Hobbs, a spokesman from the California Association of Mortgage Bankers agreed that uneven local ordinances are likely to increase the costs of lending. Hobbs advised that local legislation is unnecessary due to California State Senate Bill 1137, which was recently approved to address blight. Yet according to Houston, the statewide measure falls short because it fails to address upkeep needs during the months between the time when foreclosure begins and when the lender takes title.

Internet through electrical power network introduced in Bucharest

Tuesday, March 22, 2005Between 10 to 15 of Bucharest’s 61 Unirii Boulevard residents will be able to connect to the Internet through their power lines. Starting from May of this year, a trial was organised by Electrica Muntenia Sud, the electricity company of Bucharest and Southern Romania.

The technology, known as Power Line Communications (PLC), enables the transmission of broadband Internet and fixed line telephony data through the existing electrical power network. The technology, in use by 13,000 people in 30 countries throughout the world, is considered very advantageous due to its high speeds and low cost. It uses infrastructure that is already available in most people’s homes.

Once the Unirii Boulevard trial concludes, and if it is successful, Electrica Muntenia Sud will roll-out the PLC Internet plan to the mass market. It is expected to be embraced by Romanians because its data transfer speed of 5Mps is available for a monthly subscription fee of less than 15 euro.

Bucharest is the first city in Southeastern Europe to trial such innovative technology.

While Martin recommends consulting an ear-nose-throat (ENT) medical specialist, she points out that there is often no medical cure for tinnitus. Instead, a masking device is usually prescribed. This is like a hearing aid, except that it emits its own noise intended to distract the patient from the sound of tinnitus. Not all patients take to it, though. Martin presents the case of her 43-year-old female patient who could not be helped by several doctors in seven years because her tinnitus was caused by stress. She also suffered from extreme anxiety and had panic attacks. Her condition was progressively getting worse. After the second reflexology treatment, the tinnitus stopped. After the third treatment, a slight ringing returned but also stopped before the day ended. The same happened after the fourth treatment. After the sixth treatment, the tinnitus was totally eliminated. Her panic attacks were also resolved. She became more relaxed and was definitely happier. Martins other tinnitus patient was a 22-year-old male who had been experiencing high-pitched noise in both ears especially at night for three months. As a result, he could not sleep well. Medical tests, however, came out negative. Once again, the root cause was stress since he had just come from a problematic relationship. The patient was getting depressed. After the second reflexology treatment, the ringing noise decreased, remaining only slightly in the left ear and enabling him to get better sleep. After five treatments, the tinnitus was completely cured. He also became more relaxed and more optimistic about his life. According to Martin, a large part of the success of the reflexology treatments could be attributed to the discussion of the patients problems, providing a venue for the relief of stress which was the root cause of their tinnitus. She points out that most doctors do not give enough importance to the therapeutic benefits of listening closely to their patients. Martin, on the other hand, puts great value in establishing a good relationship with her patients in therapy, endeavoring to provide them not only with care but also with encouragement and self-empowerment. Wikinews interviews John Wolfe, Democratic Party presidential challenger to Barack Obama

U.S. Democratic Party presidential candidate John Wolfe, Jr. of Tennessee took some time to answer a few questions from Wikinews reporter William S. Saturn.

Wolfe, an attorney based out of Chattanooga, announced his intentions last year to challenge President Barack Obama in the Democratic Party presidential primaries. So far, he has appeared on the primary ballots in New Hampshire, Missouri, and Louisiana. In Louisiana, he had his strongest showing, winning 12 percent overall with over 15 percent in some congressional districts, qualifying him for Democratic National Convention delegates. However, because certain paperwork had not been filed, the party stripped Wolfe of the delegates. Wolfe says he will sue the party to receive them.

Wolfe will compete for additional delegates at the May 22 Arkansas primary and the May 29 Texas primary. He is the only challenger to Obama in Arkansas, where a May 10 Hendrix College poll of Democrats shows him with 38 percent support, just short of the 45 percent for Obama. Such an outing would top the margin of Texas prison inmate Keith Russell Judd, who finished 18 percent behind Obama with 41 percent in the West Virginia Democratic primary; the strongest showing yet against the incumbent president. Despite these prospects, the Democratic Party of Arkansas has already announced that if Wolfe wins any delegates in their primary, again, due to paperwork, the delegates will not be awarded. Wolfe will appear on the Texas ballot alongside Obama, activist Bob Ely, and historian Darcy Richardson, who ended his campaign last month.

Wolfe has previously run for U.S. Congress as the Democratic Party’s nominee. On his campaign website, he cites the influence “of the Pentagon, Wall Street, and corporations” on the Obama administration as a reason for his challenge, believing these negatively affect “loyal Americans, taxpayers and small businesses.” Wolfe calls for the usage of anti-trust laws to break up large banks, higher taxes on Wall Street, the creation of an “alternative federal reserve” to assist community banks, and the implementation of a single-payer health care system.

With Wikinews, Wolfe discusses his campaign, the presidency of Barack Obama, corporations, energy, the federal budget, immigration, and the nuclear situation in Iran among other issues.

Train collision kills at least eighteen near Brussels, Belgium

Belgian authorities have confirmed that at least eighteen people died in a head-on collision between two passenger trains in the suburbs of Brussels. Other reports suggest that the death toll could be as high as 25. More than 125 passengers are reported injured, 11 of them “very seriously”. Rescuers were still trying to free bodies from the wreckage of the trains more than eight hours after the crash, which occurred in snowy conditions at 08:28 local time (0728 UTC) near the station of Buizingen in the municipality of Halle, about 15 kilometres southwest of the Belgian capital.

One of the trains involved was travelling from Quiévrain to Liège, while the other was travelling from Leuven to Braine-le-Comte. The collision saw the first two carriages of one train being forced upwards into the air over the first carriage of the second train. Eyewitnesses described the collision as “brutal”, with passengers being thrown “violently” around the carriages.

Television footage showed the two smashed locomotives forced up in the air, with passenger cars strewn over a wide area and dazed survivors wandering at the crash site. Train speed at the time of the crash was not immediately known. There are reports that one of the trains ran a stop signal.

Initial reports suggest that the Leuven–Braine-le-Comte train was on the wrong line. It is not known if the train went through a red signal or if there was a problem with the signalling. A “well informed source” quoted by French-language daily Le Soir suggested that there might have been an electrical failure in the signalling system.

The collision occurred on one of the main access lines to Brussels-South station, about 14 kilometres (9 miles) from the Belgian capital. It caused “major damage” to overhead power cables, especially on the Brussels–Mons and Brussels–Tournai lines, and high speed rail services between Brussels and France and the UK have been suspended. Thalys services were temporarily halted due to the accident, with four of its trains in the region being diverted to alternative stations. Thalys services between Brussels and Cologne have now resumed, but services to Amsterdam and Paris are still suspended.

One passenger on board, Christian Wampach, described conditions on board the train, “It was a nightmare. We were thrown about for about 15 seconds. There were a number of people injured in my car but I think all the dead were in the first car.” Wampach was in the third car.

Another passenger, Patricia Lallemand, said, “When we came out we saw dead bodies lying next to the tracks, some mutilated.”

US TV host Conan O’Brien rejects NBC’s offer to switch his show’s time slot

On Tuesday, United States television personality Conan O’Brien announced in a statement that he will no longer serve as the host for NBC‘s The Tonight Show if the network’s attempt to move his program to the post-midnight time slot comes to fruition.

This move, NBC has said, would be done to accommodate the return of the previous Tonight Show host, Jay Leno, back to late-night from his current prime-time slot.

In a long statement to the media, O’Brien states that NBC has given him a “scant” seven months to establish himself as host of The Tonight Show.

He continues to say that with his show still in “its infancy, NBC has decided to react to their terrible difficulties in prime-time by making a change in their long-established late night schedule.”

O’Brien adamantly declares that “delaying The Tonight Show into the next day to accommodate another comedy program will seriously damage what I consider to be the greatest franchise in the history of broadcasting.”

Citing his view that NBC’s purposed switch of The Tonight Show time slot could lead to the show’s ultimate “destruction,” O’Brien maintains that he would have no other choice than to step down as host—which could also include his possible move to another cable network—if this does in fact happen.

Asbestos controversy aboard Scientology ship Freewinds

Controversy has arisen over the reported presence of blue asbestos on the MV Freewinds, a cruise ship owned by the Church of Scientology. According to the Saint Martin newspaper The Daily Herald and the shipping news journal Lloyd’s List, the Freewinds was sealed in April and local public health officials on the Caribbean island of Curaçao where the ship is docked began an investigation into the presence of asbestos dust on the ship. Former Scientologist Lawrence Woodcraft supervised work on the ship in 1987, and attested to the presence of blue asbestos on the Freewinds in an affidavit posted to the Internet in 2001. Woodcraft, a licensed architect by profession, gave a statement to Wikinews and commented on the recent events.

According to The Daily Herald, the Freewinds was in the process of being renovated by the Curaçao Drydock Company. The article states that samples taken from paneling in the ship were sent to the Netherlands, where an analysis revealed that they “contained significant levels of blue asbestos”. An employee of the Curaçao Drydock Company told Radar Online in an April 30 article that the Freewinds has been docked and sealed, and confirmed that an article about asbestos ran in the local paper.

Lloyd’s List reported that work on the interior of the Freewinds was suspended on April 27 after health inspectors found traces of blue asbestos on the ship. According to Lloyd’s List, Frank Esser, Curaçao Drydock Company’s interim director, joined Curaçao’s head of the department of labor affairs Christiene van der Biezen along with the head of the local health department Tico Ras and two inspectors in an April 25 inspection of the ship. “We are sending someone so that they can tell us what happened, where it came from, since when it has been there,” said Panama Maritime Authority’s director of merchant marine Alfonso Castillero in a statement to Lloyd’s List.

The Church of Scientology purchased the ship, then known as the Bohème, in 1987, through an organization called Flag Ship Trust. After being renovated and refitted, it was put into service in June 1988. The ship is used by the Church of Scientology for advanced Scientology training in “Operating Thetan” levels, as well as for spiritual retreats for its members. Curaçao has been the ship’s homeport since it was purchased by the Church of Scientology.

According to his 2001 statement, Lawrence Woodcraft had been an architect in London, England since 1975, and joined Scientology’s elite “Sea Organization” (Sea Org) in 1986. He wrote that he was asked by the Sea Org to work on the Freewinds in 1987, and during his work on the ship “noticed a powdery blue fibrous substance approximately 1 ½” thick between the paint and the steel wall,” which he believed to be asbestos. He also discovered what he thought was blue asbestos in other parts of the ship, and reported his findings to Church of Scientology executives. Woodcraft discussed his experiences in a 2001 interview published online by the Lisa McPherson Trust, a now-defunct organization which was critical of the Church of Scientology.

The Freewinds regularly inspects the air quality on board and always meets or exceeds US standards.

Church of Scientology spokeswoman Karin Pouw responded to Radar Online about the asbestos reports, in an email published in an article in Radar on May 1. “The Freewinds regularly inspects the air quality on board and always meets or exceeds US standards,” said Pouw. She stated that two inspections performed in April “confirmed that the air quality is safe,” and asserted that the inspections revealed the Freewinds satisfies standards set by the United States Occupational Safety and Health Administration and the U.S. Clean Air Act.

Pouw told Radar that “The Freewinds will be completing its refit on schedule.” The Church of Scientology-affiliated organization Citizens Commission on Human Rights (CCHR) had been planning a cruise aboard the Freewinds scheduled for May 8, but according to Radar an individual who called the booking number for the cruise received a message that the cruise had been delayed due to ongoing work on the ship. Citing an article in the Netherlands Antilles newspaper Amigoe, Radar reported on May 6 that a team from the United States and supervised by an independent bureau from the Netherlands traveled to Curaçao in order to remove asbestos from the Freewinds.

“I stand by everything I wrote in my 2001 affidavit,” said Lawrence Woodcraft in an exclusive statement given to Wikinews. Woodcraft went on to state: “I would also comment that if the Church of Scientology claims to have removed the blue asbestos, I just don’t see how, it’s everywhere. You would first have to remove all the pipes, plumbing, a/c ducts, electrical wiring etc. etc. just a maze of stuff. Also panelling as well, basically strip the ship back to a steel hull. Also blue asbestos is sprayed onto the outer walls and then covered in paint. It’s in every nook and cranny.”

Many Scientologist celebrities have spent time aboard the Freewinds, including Tom Cruise, Katie Holmes, John Travolta, Kelly Preston, Chick Corea, Lisa Marie Presley, Catherine Bell, Kate Ceberano, and Juliette Lewis. Now magazine reported that Tom Cruise has been urged to seek medical attention regarding potential asbestos exposure, however a representative for Cruise stated he has “absolutely no knowledge” of the recent asbestos controversy. Cruise, Holmes, Travolta and Preston have celebrated birthdays and other events on the Freewinds.

There is not now and never has been a situation of asbestos exposure on the Freewinds.

In a May 15 statement to the United Kingdom daily newspaper Metro, a representative for the Church of Scientology said that “There is not now and never has been a situation of asbestos exposure on the Freewinds.” The Asbestos and Mesothelioma Center notes that agencies have recommended anyone who has spent time on the Freewinds consult with their physician to determine if possible asbestos exposure may have affected their health.

Raw blue asbestos is the most hazardous form of asbestos, and has been banned in the United Kingdom since 1970. Blue asbestos fibers are very narrow and thus easily inhaled, and are a major cause of mesothelioma. Mesothelioma is a form of cancer which can develop in the lining of the lungs and chest cavity, the lining of the abdominal cavity, or the pericardium sac surrounding the heart. The cancer is incurable, and can manifest over 40 years after the initial exposure to asbestos.

“This is the most dangerous type of asbestos because the fibres are smaller than the white asbestos and can penetrate the lung more easily,” said toxicologist Dr. Chris Coggins in a statement published in OK! Magazine. Dr. Coggins went on to note that “Once diagnosed with mesothelioma, the victim has six months to a year to live. It gradually reduces lung function until the victim is no longer able to breathe and dies.”
